Ms. Thomas, 53, has long been active in conservative circles in Washington. In the past year she has become more prominent as the founder of a new nonprofit activist group, Liberty Central, which is dedicated to opposing what she has characterized as the leftist “tyranny” of the Obama administration and Congressional Democrats. The group has drawn scrutiny in part because of the unusual circumstance of a spouse of a sitting Supreme Court justice drawing a salary from a group financed by anonymous donors.

What’s really interesting about that whole situation is that if Liberty Central were to gain a significant amount of public mindshare, that would put Clarence Thomas in the unenviable position of having to recuse himself from cases because of his wife’s political activities. In fact, some have argued that Thomas should’ve recused himself from the 2000 Al Gore/George W. Bush thing because his wife Virginia had been making efforts to compile resumes for a potential Bush administration. While her political activities are questionable at best (and a huge conflict of interest) considering her husband’s job, they’re totally legal.
» What this means for Clarence Thomas: He may have to recuse himself from a number of politically-oriented cases because of his wife’s extracurricular activities, which, as a private citizen, she’s totally allowed to do. If Liberty Central were to take off, it could be a glaring conflict of interest for the court’s most conservative judge.
